Former JusMin Stelian Ion: Magistrates' protest directly hits the litigants, not the Government

USR MP Stelian Ion, former Minister of Justice, says that the magistrates' protest will have only one effect - it will turn the entire society against them with even greater force.

"This form of protest that goes beyond the limits of the law directly hits the litigants, not the Government. It is a deeply uninspired movement. Today, the magistrates are demanding the withdrawal of the Government's draft law on special pensions. They are not proposing its modification or improvement through amendments, but simply the withdrawal of the bill. Basically, one power in the state considers itself above the others, exceeds its constitutional role and flagrantly violates the principle of separation of powers in the state and equality before the law. Because, as the president of the Supreme Council of the Magistracy (CSM) explains to us, they consider themselves "unique", that is, special in relation to all other professional categories, they would probably like to establish their own pensions, salaries and retirement age. But things cannot work like that in a rule of law", Stelian Ion wrote on Tuesday on Facebook.

According to him, "it would have been extraordinary if the majority of those in the CSM had also been concerned about the fact that criminal cases are being time-barred, that some judges make controversial decisions, that some prosecutors sleep on cases, that the phenomenon of corruption in the judiciary is no longer investigated and sanctioned, and that there is a deep sense of injustice in this country, and this is not because of the media, politicians or influencers."

"But the concerns of the Supreme Court of Magistracy seem to focus only on preserving certain rights. That's about where we've come," concluded the former Minister of Justice.

All 16 courts of appeal in the country requested, following general assemblies of judges organized on Tuesday, the urgent withdrawal of the draft law on the reform of magistrates' service pensions.

According to a post on the Facebook page of CSM, the assemblies of judges "requested the other two powers of the state urgently withdraw the draft law on the reform of magistrates' service pensions and cease the aggressive campaign against the judicial authority, which seriously affects the rule of law, the rights and freedoms of citizens that can only be effectively guaranteed by an independent judiciary".

In this context, it was decided that, starting Wednesday, the activity would be carried out according to the decisions of the general assemblies of judges, in order to raise an alarm regarding the major risk of destabilization of the judicial system generated by the said normative approach.
